(hereinafter referred to as “UXD Talks”, “Company”, “We”, “Us”)

Effective Date

These Terms shall become legally binding and effective upon the earlier of:
(a) Successful payment of the applicable course fee; or(b) Digital acceptance of these Terms during enrollment.
Enrollment confirmation by the Company is administrative in nature and does not affect enforceability.
By enrolling, the Participant (“Student”) agrees to be legally bound by these Terms.

WEBSITE & PLATFORM COVERAGE

This Privacy Policy applies to all services, programs, platforms, events, websites, applications, communication channels, and community initiatives operated by UXD Talks, including but not limited to:
  • UX Industry-Fit Course (UXFIC)
  • Workshops and bootcamps
  • Online and offline events
  • Aptitude tests and assessments
  • Community initiatives and networking programs
  • Speaker and contributor applications
  • Event registrations
  • Newsletters and marketing communications
  • Website interactions and platform usage
  • Community groups and discussion forums
  • Event media, recordings, and educational content
This Policy applies to all users, visitors, attendees, students, speakers, mentors, contributors, volunteers, recruiters, partners, and community participants interacting with UXD Talks platforms or services.

1. STATUS AS DATA FIDUCIARY

UXD Talks acts as a Data Fiduciary under the Digital Personal Data Protection Act, 2023 (“DPDP Act”) in relation to personal data processed for the UX Industry-Fit Course (UXFIC) and related services.
Personal data shall be processed only upon obtaining clear, specific, informed, and affirmative consent through a granular consent mechanism (e.g., purpose-specific checkbox or written agreement).
Consent shall not be bundled across unrelated purposes.
Accessing the website alone does not constitute consent unless accompanied by affirmative action.

2. NOTICE AT TIME OF COLLECTION

At or before collection of personal data, UXD Talks shall provide a notice specifying:

  • Manner of processing
  • Withdrawal mechanism
  • Grievance redressal details

Data Principal – Individual to whom the personal data relates.
Data Processor – Entity processing personal data on behalf of UXD Talks.
Consent – Free, specific, informed, unconditional, and unambiguous indication of agreement.
Legitimate Use – Processing permitted under Section 7 of the DPDP Act.

4. DATA MINIMIZATION & PURPOSE LIMITATION

UXD Talks shall collect and process only such personal data as is:

Personal data shall not be processed for behavioral profiling, automated advertising, or unrelated analytics without explicit consent.

5.6 Media, Event & Recording Data

UXD Talks may collect, process, store, reproduce, archive, publish, or use:

  • Speaker recordings
  • Raw footage
  • Livestream recordings
  • Community media content
  • Promotional media assets
Such content may include a participant’s name, image, voice, likeness, submitted content, participation details, or interaction during events, sessions, workshops, or community activities.

6. COOKIES & ANALYTICS

Our website and LMS may use cookies, session storage, or third-party analytics tools for:
  • Performance monitoring
  • Security
  • User experience improvement
Where legally required, cookie usage shall be subject to user consent.
Users may control cookies through browser settings.
Analytics or tracking technologies may include tools such as:

No unrelated processing shall occur without fresh consent.

7A. EVENT PHOTOGRAPHY, RECORDINGS & MEDIA USAGE

UXD Talks events, workshops, webinars, meetups, community sessions, and educational activities may be photographed, audio-recorded, video-recorded, transcribed, archived, livestreamed, edited, reproduced, distributed, or published for educational, operational, documentation, archival, community, promotional, security, research, or marketing purposes.
Participants acknowledge that their participation, image, likeness, voice, comments, interactions, submitted content, or presence may appear in:
  • Event photographs
  • Livestreams
  • Session recordings
  • Event galleries
  • Promotional videos
  • Social media posts
  • Website content
  • Educational archives
  • Community highlights
  • Marketing campaigns
Users who do not wish to appear in public-facing media may contact UXD Talks prior to participation, though incidental appearance in crowd or background footage may not always be avoidable.
Internal operational recordings maintained for moderation, compliance, educational continuity, quality assurance, archival, or security purposes may continue to be retained notwithstanding such requests.

7B. SPEAKER, CONTRIBUTOR & SESSION CONTENT

Sessions conducted by speakers, mentors, instructors, panelists, contributors, or community participants may be recorded, edited, transcribed, archived, reproduced, distributed, published, or reused by UXD Talks for educational, operational, promotional, documentation, research, archival, community, or marketing purposes.
Such usage may include:
  • Raw footage storage
  • Edited highlights and clips
  • Reels and short-form content
  • Social media distribution
  • Website publication
  • Streaming platform uploads
  • Educational archives
  • Training and promotional materials
Where applicable, separate agreements or consent mechanisms may additionally govern speaker or contributor recording rights and content usage permissions.
Opinions expressed by speakers or contributors are personal to them and do not necessarily represent the official views of UXD Talks.

8. LEGAL BASIS FOR PROCESSING

Processing is based on:
  • Explicit consent
  • Contractual necessity
  • Compliance with applicable law
  • Legitimate uses under Section 7 of DPDP Act
Withdrawal of consent may impact service delivery where processing is contractually essential.

8A. AI TOOLS, TRANSCRIPTION & AUTOMATED ASSISTANCE

UXD Talks may use AI-assisted tools, automated systems, transcription services, note-generation systems, summarization tools, accessibility technologies, analytics platforms, or productivity tools for operational, educational, documentation, moderation, accessibility, research, security, or community purposes.
Such usage may include:
  • Session transcription
  • Automated meeting summaries
  • AI-generated notes
  • Search and indexing
  • Educational analytics
  • Accessibility support
  • Operational productivity tools
UXD Talks does not currently undertake automated decision-making that produces legal or similarly significant effects unless separately disclosed and lawfully permitted.

9. DATA RETENTION

Personal data shall be retained:
  • During the course period
  • Up to 3 years post-completion for academic verification and certification validation
  • Longer where required by law
  • As necessary for dispute resolution or legal defense
Retention obligations required under law or for defense of claims shall override erasure requests.
Data shall be securely deleted or anonymized after expiry of retention period.
A documented Data Deletion Log shall be maintained.

10. DATA SHARING & PROCESSOR GOVERNANCE

Data may be shared with:
  • Instructors and mentors
  • Cloud service providers
  • LMS platforms
  • Payment processors
  • Communication platforms
  • Legal advisors
  • Government authorities where required
All Data Processors shall be bound by contractual confidentiality and security obligations.
UXD Talks remains responsible for data processed by its Data Processors under applicable law.
Third-party platforms or service providers may include:
  • Video conferencing platforms
  • Learning management systems
  • Cloud hosting providers
  • Payment gateways
  • Community communication platforms
  • Analytics providers
  • Email service providers
  • Social media platforms
  • Content hosting providers
Such third parties may process personal data in accordance with their own terms, privacy policies, and legal obligations.

11. PLACEMENT & RECRUITER DATA SHARING

Personal data shall be shared with third-party recruiters only upon:
  • Explicit, purpose-specific written consent from the student
  • Clear disclosure of data categories being shared
Recruiters shall act as independent Data Fiduciaries for subsequent processing.
UXD Talks shall not be responsible for independent processing undertaken by such recruiters beyond the scope of consent.

11A. APTITUDE TESTS, ASSESSMENTS & EVALUATIONS

UXD Talks may conduct aptitude tests, assessments, assignments, quizzes, interviews, workshops, evaluations, or screening exercises as part of courses, workshops, hiring initiatives, events, or community programs.
In relation to such assessments, UXD Talks may process:
  • Test submissions
  • Scores and evaluation metrics
  • Performance analytics
  • Session activity logs
  • Device and browser metadata
  • Login timestamps
  • Anti-cheating or integrity monitoring data
Such information may be used for academic evaluation, eligibility determination, fraud prevention, platform security, research, analytics, performance improvement, certification, or operational purposes.
Assessment results are indicative in nature and do not constitute professional certification, employment guarantees, or legally recognized qualifications unless expressly stated otherwise.

12. CROSS-BORDER DATA TRANSFER

Personal data may be processed outside India through cloud or SaaS providers.
No transfer shall occur to countries restricted by notification of the Government of India.
Appropriate contractual safeguards shall be implemented to ensure protection standards consistent with applicable law.

13. DATA SECURITY & GOVERNANCE

UXD Talks implements:
  • Role-based access control
  • Access logging and monitoring
  • Encryption where feasible
  • Restricted administrative privileges
  • Confidentiality obligations for personnel
  • Periodic internal compliance review
Nothing in this Policy limits liability where prohibited under applicable law.

14. DATA BREACH RESPONSE

In the event of a personal data breach likely to cause harm or as required under law:
  • Affected Data Principals shall be notified as soon as reasonably practicable.
  • The Data Protection Board of India shall be informed where applicable.
  • Mitigation measures shall be implemented.
A documented Data Breach Response SOP is maintained internally.

15. AUTOMATED DECISION-MAKING

UXD Talks does not currently undertake automated decision-making or profiling that produces legal or significant effects.
If implemented in future, explicit disclosure and consent mechanisms shall be established.

16. RIGHTS OF DATA PRINCIPAL

You have the right to:

  • Seek erasure (subject to lawful retention)
  • Withdraw consent
  • Nominate a representative

  • Escalate complaint to the Data Protection Board of India

Certain data is essential for enrollment and certification.
Failure to provide required data may result in denial or suspension of services.

18. MEDIA & MARKETING CONSENT

Live sessions may be recorded for internal academic purposes.
Separate consent shall be obtained for:
  • Testimonials
  • Public project display
  • Promotional content
Refusal of marketing consent shall not affect enrollment.
Marketing consent may be withdrawn at any time.
Event photographs, workshop recordings, community media, speaker sessions, livestreams, and related media assets may be used for:
  • Website publication
  • Social media distribution
  • Educational archives
  • Marketing campaigns
  • Community highlights
  • Promotional materials
  • Documentation purposes
Internal operational recordings retained for security, moderation, quality assurance, compliance, archival, or educational continuity purposes may continue to be retained irrespective of marketing consent withdrawal.

19. CHILDREN’S DATA

Programme is intended for individuals aged 18 years or older.
We do not knowingly process data of minors.

COMMUNITY MODERATION & PLATFORM SAFETY

UXD Talks reserves the right to monitor, moderate, restrict, suspend, remove, investigate, or take appropriate action regarding user participation, submissions, communications, or activities in order to:
  • Maintain community safety
  • Prevent abuse, harassment, or discrimination
  • Prevent spam, fraud, or misuse
  • Enforce platform standards
  • Protect intellectual property
  • Comply with legal obligations
  • Maintain operational integrity
Users engaging in harmful, unlawful, misleading, defamatory, abusive, disruptive, or fraudulent conduct may have their participation restricted or terminated without prior notice where reasonably necessary.

20. POLICY MODIFICATION

Updates shall be published on the official website.
Material changes may be communicated via email or LMS notification.
Continued use after notification constitutes acceptance.
The latest version of this Privacy Policy shall supersede prior versions upon publication unless otherwise stated.

21. GOVERNING LAW & STATUTORY RIGHTS

This Policy is governed by laws of India.
Disputes shall be resolved through arbitration seated in Gaya, Bihar in accordance with the Terms & Conditions.
Nothing in this Policy restricts statutory rights under the Digital Personal Data Protection Act, 2023.
